The charge against defense counsel is that forced arbitration clauses are really designed to make it impractical—even impossible—for injured parties to bring valid legal claims against corporate defendants. Arbitration is presumptively individual, and often the stakes are too low and the costs too high for a plaintiff to proceed alone. On the other hand, the criticism of plaintiffs’ counsel is that they bring claims that defendants feel forced to settle to avoid the costs of arbitration. That can occur when defendants’ arbitration clauses require them to pay expenses associated with the arbitration process, especially upfront fees. Each side asserts that the other has found a way to prevail regardless of the merits. Are they both right? Is neither right? Is this issue ethical or merely strategic?

But requiring disclosure or imposing other regulations may be a good idea regardless of whether one thinks there is too much private litigation in the US, too little, or some combination of the two. This panel will discuss the ethics of third-party litigation funding, some its virtues and vices, and what the implications are for regulating the practice through the Federal Rules of Civil Procedure or otherwise.
